I acknowledge and agree that my participation in the Outlaws Elite Basketball Academy (the "Program") organized by Outlanders Sports (the Non-Profit) involves inherent risks of bodily injury, property damage, and other damages that may arise from my participation in the Program. I am participating voluntarily and with knowledge of the risks involved.
In consideration for being permitted to participate in the Program, I hereby waive, release, and discharge Outlanders Sports (the Non-Profit), its officers, directors, employees, volunteers, agents, representatives, successors, and assigns from any and all claims, actions, causes of action, suits, damages, and liabilities of any kind whatsoever, whether known or unknown, arising out of or in connection with my participation in the Program, including, but not limited to, personal injury, death, or property damage, whether caused by the negligence of Outlanders Sports (the Non-Profit) or its officers, directors, employees, volunteers, agents, representatives, successors, and assigns, or otherwise.
I further agree to indemnify, defend, and hold harmless Outlanders Sports (the Non-Profit), its officers, directors, employees, volunteers, agents, representatives, successors, and assigns from any and all claims, actions, causes of action, suits, damages, and liabilities of any kind whatsoever, including reasonable attorney's fees, arising out of or in connection with my participation in the Program.
I certify that my child is in good physical condition and capable of participating in the Program. I acknowledge that I have read this waiver and hold harmless agreement and fully understand its terms and conditions. I acknowledge that this waiver and hold harmless agreement is binding on me, my heirs, executors, administrators, and assigns.
This waiver and hold harmless agreement shall be governed by and construed in accordance with the laws of the state of [insert state]. If any provision of this waiver and hold harmless agreement is held to be invalid or unenforceable, such provision shall be deemed to be severed from this waiver and hold harmless agreement, and the remainder of the waiver and hold harmless agreement shall remain in full force and effect.
